The Board of Zoning Appeals tabled the application by James and Edna Scott for a variance to allow a pond to remain on their property in Chester Gap. The pond is in violation of the county’s zoning ordinances because it it is closer than 100 feet to the neighboring property, and they do not have written permission from the neighbors.
Their next-door neighbors, Robert and Lucy Rutherford, first complained to County Administrator John McCarthy about the location of the pond on the Scotts’ .84-acre lot last spring. Mr. McCarthy followed up by writing to the
