Mr. Bird asked her to sketch her septic system on the maps she supplied.
"The lines go hack to C’hadwell. not to the pond,” she said.
"She says we took the fence down," Mrs. Scott continued. "That was our fence. We're waiting now until the surveyors come back. We're going to put up a new fence."
Mr. Bird established that the complaint about the septic system was filed Oct. lb. "From the time the Rutherfords were aware of the pond being in and the time they decided it was a nuisance, it was either six months or nine months," he said. “Their complaint was aggravated by the weather this summer.”
"1 have a problem with the idea that the pond creates humidity," Mr. Gottleib commented.
“We need to wait until the survey is complete and until the health department acts," Mr. Bird said. “One of the findings we have to make in acting on a variance is that it doesn’t do any substantial damage to the neighbors."
“In any event, they didn't get a permit from the health department to put in the septic system," Mr. McCarthy noted.
“What did you have before the septic system?” Mr. Zindel asked.
“We had an outside toilet,” Mrs. Scott replied.
Richard Leizear testified that he helped Mr. Scott build the pond. “When they were going to build the pond, Bob was out there,” Mr. Leizear said. “He said it would make the place look better. He said tc make it bigger, but James said nt because he wanted to stay away from the property line.”
Mr. Leizear said that the Scotts had stocked the pond with fish and were feeding them last September. In early July they all died. “One day there were no dead ones, and the next day all of them were dead,” he said. “They have a complaint about the smell. Right here in this corner
