Mr. Bird suggested that the BZA members also visit the site before acting on the variance request. "The appearance we can judge, but not the health risk," he said.
The Rutherfords’ daughter Betty West testified that recently her parents had deeded two acres of their property to her as part of a family subdivision. “We can sit all day and talk about a bunch of good old boys sitting around and drinking beer," she said. "It doesn’t mean anything; there was no written permission."
Mr. Bird asked her if she considered the pond "an eyesore."
"The most important thing is to get a health department study,” she said. "The fish died for some reason."
The BZA voted unanimously to wait for results of a health department study and an on-site visit before taking action.
Mr. McCarthy said he would make certain sanitarian Jack Lockhart was informed that the BZA wants a report by its Nov. 22 meeting.
In another request for a variance. the BZA approved Lewis Butler’s application to allow him to build a house less than f>0 feet from the side lot line of his land in the Town of Washington because of a drainage swale on the other side of the lot. Mr. Butler owns both lots involved, but intends to deed the one involved in the variance request to his daughter Eunice Butler Lewis. He said he would probably deed the other lot to another of his children.
