David Andre, the Bartleses’ lawyer, said Tuesday that the couple is suing United States Fidelity and Guaranty insurance company and agent Doug Moler because their claim for damages resulting from the sinkhole was denied.
Andre said Moler led the Bartleses to believe they had all possible coverage on their home. Additional sinkhole coverage could have been purchased through the USFG for 35 cents more per $1,000 of coverage. The extra surcharge would have totaled $23.80 more per year, according to Andre. The Bartles were under the assumption that, “if something could be covered, it was covered,” Andre said.
Moler had no comment on Tuesday.
“For want of a nail, the kingdom was lost,” Andre added.
The complaint against USFG is that the company projected bad faith, First in delaying a request for a decision, which took a month, and also for neglecting to cover personal property loss, which Andre said is expressly covered in the policy.
