At a misdemeanor appeal trial in Rappahannock County Circuit Court on Monday, assault and battery charges against Edward A. Wince, 44, of Flint Hill, were dismissed.
The case was sent to Circuit Court for appeal, after Mr. Wince had been found guilty in District Court earlier this year. Mr. Wince had been accused of assault and battery by William H. James, Jr., of Flint Hill, a neighbor of Mr. Wince’s, on October 9,1993.
Mr. James claimed that on that date he was standing by a brush pile • in his yard when Mr. Wince and his father, Robert Wince, came up the driveway in their pickup truck. The Jameses and Winces share a 20 foot right of way* and each enter their property through their own cattle gate. Mr. James testified that the night before, the Winces had called the Sheriffs Department to complain about a brush fire that Mr. James had in his yard, and that he could hear them cursing about him to the deputy who responded to the call.
