Fauquier County, he said that Mr. Coldsmith had tested positive for use of cocaine twice that month. Mr. Coldsmith was asked to return to court to show cause why his probation should not be revoked.

In a subsequent letter to the court dated Feb. 11, 1997 from Mr. Pavelko, he said that Mr. Coldsmith failed to keep two appointments with him. Also, he said that Mr. Coldsmith had called him and said he wanted to turn himself in to the Rappahannock County Sheriff’s Office, which he did on Jan. 27.

There is also no evidence in the court file that the $971.75 was paid by the due date of Feb. 1.

Commonwealth’s Attorney Peter Luke asked that a finding of guilt be entered for Mr. Coldsmith in court last Thursday, reminding the court that the charge of cocaine possession is a felony.

Mr. Coldsmith was remanded to the custody of the Sheriff’s Office and will return to court for sentencing on May 1, after a presentencing report is obtained.
