NOTICE OF PUBLIC HEARING BY THE BOARD OF SUPERVISORS OF RAPPAHANNOCK COUNTY TO CONSIDER PROPOSALS THAT THE COUNTY OF RAPPAHANNOCK: (1) ENTER INTO A CONTRACT TO PURCHASE THE AILEEN PROPERTY FOR $137,500 AND AMEND THE 1999-2000 COUNTY BUDGET TO APPROPRIATE $140,000 FOR THIS PURPOSE; AND, (2) PLACE RESTRICTIONS ON THE PROPERTY SO ACQUIRED LIMITING THE USE OF GROUNDWATER UNTIL CERTAIN ENVIRONMENTAL STANDARDS ARE MET; AND, (3) ENTER INTO AN AGREEMENT WITH THE ADJOINING FLINT HILL PENTECOSTAL CHURCH TO PROVIDE IT WITH WATER UNTIL ITS WELL MEETS CERTAIN ENVIRONMENTAL STANDARDS; AND, (4) COMMIT ITSELF TO A PROGRAM OF WATER TESTING TO INSURE THE SAFETY OF THE GROUNDWATER IN THE AREA AROUND THE AILEEN PROPERTY UNTIL CERTAIN GROUNDWATER STANDARDS ARE MET. The County of Rappahannock, Virginia, proposes to enter into a Contract of Sale wherein it shall purchase from Aileen, Inc., a New York corporation in bankruptcy, 33 acres, more or less, (Tax Map 13 parcel 31) located on Route 641 near Flint Hill, Virginia, for the sum of $137,500 and subject to all delinquent real estate taxes. The property the County proposes to acquire has been enrolled by the County in the Virginia Voluntary Remediation Program (Code of Virginia §10.1-1429.1 et seq.) due to groundwater contamination on site and on the adjoining property of the Flint Hill Pentecostal Church. As a requirement for the receipt of a Certification of Satisfactory Completion of Remediation under said Program giving the County immunity from enforcement of State environmental laws, the County proposes, upon acquiring the said 33 acres: (a) To place restrictive covenants on the property, which restrict groundwater use until certain water standards are met; and, (b) To enter into an agreement with the adjoining Flint Hill Pentecostal Church to provide it with water until its contaminated well meets certain standards; and, (c) To commit to a groundwater monitoring program to insure the safety of persons using water on the 33 acres and on surrounding properties. If the County acquires the Aileen Property the budget for fiscal year 1 July 1999 through 30 June 2000 will be amended to appropriate the sum of $140,000 to fulfill the financial obligatiohs of the County associated with the purchase. This is done pursuant to §15.2-2507 of the Code of Virginia. A copy of the Site Characterization Report and the Post-Certification Monitoring Plan, which define the obligations of the County to monitor groundwater after purchase of the property, are on file fqr public inspection weekdays between 8:30 a m. and 4:30 p.m. in the office of the County Administrator, 290 Gay Street, Washington, Virginia, as are a proposed Declaration of Restrictive Covenants, and Agreement to Provide Water and for Restrictive Covenants (relating to the Fhnt Hill Pentecostal Church property).

A public hearing shall be held on all the aforesaid proposals at the Rappahannock County Courthouse, Gay Street, Washington, Virginia, at 7:00 p.m. on 22 June 2000.
