An examination of the law that provides for performance contracting procedures — and recently posted publicly by Dr. Chappell - states that “such contracts shall stipulate that the agreement does not constitute a debt, liability, or obligation of the contracting entity, or a pledge of the faith and credit of the contracting entity.”
The savings must be guaranteed, meaning that specific dollar amounts, by year, over the life of the contract are written into the contract itself.
If Ameresco must guarantee energy savings, then that risk must be built into the contract, meaning that the actual line item contract prices would be higher.
Given the higher degree of competitiveness among contractors in this economic recession, the individual projects would very likely be much less if put out to competitive bid.
That is essentially the view of Ron Frazier and others who oppose the contract.
