lots or less without the authorization from the Planning Commission. Dawson plans 16 lots on his tract. The question raised in Dawson’s application is whether a rezoning of the 480 acres is required before the land can be subdivided, according to Baumgardner.

Baumgardner said the question on rezoning is based on inconsistencies in the county ordinances. Section 68-1 of the Rappahannock Subdivision Ordinance states that “no final plat of any subdivision containing more than five (5) lots shall be recorded unless or until it shall have been rezoned and approved by the governing body."

But section 6-9 says “the final plat of a subdivision containing more than five (5) lots, anyone of which is less than twenty-five (25) acres, shall not be approved until the lot, parcel or tract of land to be subdivided is rezoned as R-l District or RS-1 District.”

Section 6-1 of the Zoning Ordinance also states that “no subdivision containing more than five (5) lots, anyone of which contains less than twenty-five (25) acres, shall be approved by the governing body until the entire area of the proposed subdivision is rezoned to RS1.”

All the lots in Dawson’s proposed Sommarbeth Estates Subdivision—on property currently zoned agricultural and conservation—are 25 acres or larger.
