In a letter dated May 15, the Rappahannock Board ol Zoning Appeals notified P. E. Steve DeMent that he has until June 15 to modify the addition to his Sperryville antique business so that the new building complies with the special use permit issued for its construction.

The permit for a garagestorage area addition was first issued in April, 1977. In June, the BZA revoked DeMent’s permit on grounds that construction (1) did not meet requirements on setback from the adjoining property line and (2) was not an extension of the existing structure as stipulated in the permit.

Following DeMent’s appeal of the BZA’s action to circuit court, Judge Rayner V. Snead ruled on August 31, 1978, that the BZA had authority to both issue and revoke the special use permit. In a second ruling on November 13, 1978, Snead held that the BZA’s action in revoking the permit was
