Neither the right to buy or sell land nor the right to will or inherit land is affected by approval of an ag district. Any landowner may petition the board of supervisors for the right to withdraw from a district before the review period with the right to appeal the decision in circuit court. As a matter of right, heirs may withdraw land from the district upon inheriting property.

John Capelle described the AFD Act as “a rare opportunity for almost individualized land use planning.” He noted that the Act also places a burden on the planning commission “to nitpick...to evaluate, to make sure that approval of a district is in the public interest...As with any law that is passed, it’s only as good as its administration,” he said.
