If the House had stood by one candidate and the Senate by another, the sitting 20th Circuit Court judge. Carleton Penn of Loudoun, would have named the new 20th District Juvenile and Domestic Relations Court judge after the General Assembly finished its 60-day session this March.
However, Judge Penn would not have been bound by Senate and House nominees. He could have appointed any qualified attorney to succeed Judge Moffett.
Hertz and Martin tied on the first caucus ballot. Hertz won by one vote on the second ballot and then became the choice of both houses. Waddell abstained on the Senate floor from voting on the list which contained Hertz’s name.
