Rappahannock’s Board of Zoning Appeals members, in a split decision, last Thursday issued the county’s only current variance for a trailer as a permanent residential dwelling.

The variance to the zoning ordinance’s prohibition against mobile homes was granted to Annie Mary Jackson on the grounds of hardship.

Section 16-2-2 of the ordinance stipulates th^t a variance may be granted if physical characteristics of the property are such that strict application of the ordinance would prohibit or restrict use of the land.

According to Section 16, the BZA may grant a variance after determining from the evidence presented that such action is necessary to “alleviate a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience sought by the applicant."

According to Mrs. Jackson, she lives in a house on the parcel that she owns in Jackson District while her son and his family reside in the mobile home located on the same property. The trailer has been in place since before the zoning ordinance was adopted and thus is a legal non-conforming use under the “grandfather clause.”
