Zoning Administrator Evan McNear reported that he’d discussed the issue with Baumgardner and that the commonwealth attorney confirmed that the BZA had the right to grant a variance for the trailer.

Baumgardner added that Mrs. Jackson’s plan to replace the old trailer with a new unit doesn’t fall under the alterations and renovations allowed on onconforming uses. The only way the new trailer can be approved, he said, is for Mrs. Jackson to obtain a variance by showing a hardship.

"Are there other trailers on the property?” George Muth asked.

“Yes, but they were all there before the regulations (in the zoning ordinance were adopted),” McNear replied.
