wherever one is engaged in target shooting, that the definition would be a simple matter of common sense and common usage. However, a shooting range would be commonly understood as something on a larger scale than shooting squirrels or shooting at tin cans. The sportsmen’s association had built berms, barriers and shooting stands, Mahon said. And so their construction seemed to be “a grand scale shooting range," ho added.

In his opening statement, defense attorney Richard Dulaney contended that the zoning ordinance is ambiguous and sets no clear definition of what a firing range is.

Ranges Special?

A firing range is a use listed in the ordinance amendment as specifically needing a special use permit, the judge countered. Is the same definition problem seen in some 20 other uses which need special use permits?, he asked. Or is there a public perception of just what constitutes a shooting range?

Dulaney argued that all target shooting everywhere in the county would be outlawed bv Mahon's definition. Routine weekend target shooting by groups such as the Washington Volunteer Fire Department could be prohibited, Dulaney asserted. This, he insisted, would be an infringement on the constitutional right to bear arms, a right which is even more specifically written in the Virginia constitution as the right “to train to arms.”
