Baumgardner countered that the firing range was intended to be used by a private club. The zoning ordinance amendment simply says that a firing range in an agricultural zone needs a special use permit, he said. The ordinance does not limit this to commercial or public firing ranges, Baumgardner pointed out.
Judge Robertson said he was satisfied that the ordinance is clear. The supervisors saw fit to limit firing ranges to agricultural zones, and not just commercial ones, but all firing ranges. Robertson added that one could “look to common parlance” to understand what the supervisors meant by a firing range.
