Therefore, after his inspection, he wrote letters to the Planning Commission and the Board of Supervisors, saying that the sportsmen were engaged in an activity that required a special use permit and didn’t have one. Therefore, they were in violation, said Konick.
Upon cross-examination, Konick told Mahon he had contacted neither Bowers nor Settle after writing the Planning Commission and Board of Supervisors.
Why hadn’t he contacted Bowers, Mahon asked.
Flagrant Violation
Konick answered that he was sure Bowers knew about the ordinance. “It was a flagrant and intentional violation and there wasn’t much sense in contacting him,” said Konick.
