Willis dated April 16, 1937, and of record in the Clerk's Office of said county in Deed Book 40, page 496; thence leaving said River and with the lines of said 104.4 acre tract as surveyed March 4, 1937 by Lee Poe, Surveyor, North 3814 degrees 30.3 poles to a point; thence North 41% degrees West 16.6 poles to a point; thence North 2414 degrees East 13.9 poles to a point; thence South 8216 degrees East 13 poles to a walnut; thence North 73% degrees East 15.3 poles to a point; thence North 38% degrees East 113.9 poles to a planted stone on south side of road, comer to the lands of Hawkins and the lands now or formerly owned by Dr. Phillips; thence leaving said tract of 104.4 acres and with the road leading from Slate Mills to F. T. Church, as called for in the deed from A. T. Walden and wife to Albert G. Willis and William Colvin dated March 18, 1871 and of record in Deed Book N, page 165, North 48 degrees West 50 poles to a point in said road; thence North 40 degrees West 12 poles to a point in said road; thence North 58Vi degrees West 15 poles to a point in said road; thence South 87 degrees West 52 poles to a comer in said road near a stone planted, also near a permisson bush, corner to the lands now or formerly of said Walden, South 1014 degrees West 192 poles to a walnut on Hughes River, comer to same; thence with said River, South 79 degrees East 40 poles to the place of beginning, CONTAINING 96.6 acres, more or less” LESS HOWEVER, the following off conveyances: (1) One acre more or less to E. Acy Fry by deed dated the 19th day of January, 1968, and recorded in Deed Book 91, at page 722, and (2) One acre more or less to Peggy Jean Sisk by deed dated the 17th day of June, 1968, and recorded in Deed Book 91 at Page 725, and (3) 5417 acres to Eugene A. and Marietta T. Nifenecker by deed dated the 6th day of November, t969, and recorded in Deed Book 96 at Page 138, and (4) 5 acres more or less to Virginia Adelaid Dodson by deed dated the 81h day of December, 1969, and recorded in Deed Book 96, at Page 361. TERMS OF SALE: ALL CASH! A bidder's deposit of ten percent (10%) of the winning bid shall be required on the sale date, said deposit to be in cash or certified collectible funds or such other form as may be approved by the Substitute Trustee in advance of the auction in his sole discretion. All conveyancing, recording revenue costs, and expenses incident to the settlement and transfer of the property shall be at the sole cost and expense of the purchaser. Settlement and compliance with all terms of sale shall be on or before April 22,1985, and, in the event of a default by the purchaser, the Substitute Trustee shall have the right to declare a forfeiture of the deposit, keep the deposit, readvertise and resell the property at the sole risk and cost of the defaulting purchaser, and to exercise such other legal and equitable remedies available against such defaulting purchaser.
The Substitute Trustee makes absolutely no representa tions as to the physical characteristics of the property or any improvements thereon, and prospective bidders are encouraged to inspect the property prior to the sale date. The propery is to be sold in 'AS IS' condition, and conveyed by SPECIAL WARRANTY DEED subject to all covenants, easements and other matters of record or visible upon the property at the time of sale. The property is subject to the lien of a First Deed of Trust dated Spetember 15,1983 and recorded September 20,1983 among the aforesaid land records in Deed Book 145 at page 601 securing a note payable to the United States Department of Agriculture Farmers Home Administation. which lien shall be discharged out of the proceeds of this sale.
