cial building would no longer qualify as a non-conforming use.

Said Konick to the commission, “...the building permit for the new commercial building...was only for a retail store,” adding that it didn’t allow for a living unit.

During discussion with the planners, Konick also noted objections made by Emiel Smet, the county building official, in reagard to Bowers’ practice of living in his commercial building.

“The ordinance speaks about a dwelling unit for a watchman or a caretaker...” said Konick. “He (Smet) feels that that implies that it not be a fulltime dwelling unit...that it implies that the person who stays there as the caretaker or the watchman has a permanent residence elsewhere, which is probably not the case here.”

The building official also told Konick that it’s a violation of the statewide building code to have a dwelling unit of any kind in a structure storing explosive materials such as gunpowder.

“Since this is a gun shop...it would appear that he (Smet) would not be able to issue an occupancy permit...so long as they’re storing any kind of ammunition in there,” said Konick.

Konick also told the commissioners that he believes Bowers is violating the zoning ordinance by putting up for sale the trailer that, in effect, should have been removed from his property some time ago, according to the terms of the special use permit.
