Lack of enforcement of BZA recommendations could “prejudice further applications," according to BZA Chairman Lee Bird. “It’s in everybody’s interests to get these conditions met,” he said.
In Rappahannock County, the Zoning Administrator must see that BZA stipulations are enforced.
Emiel Smet, current Zoning Administrator, said that he is resigning from his position because he does not have enough time to do the job assigned him. Smet announced his resignation earlier this fall.
The BZA said that the Fryes’ application must be re-submitted to the Planning Commission. The Planning Commission could not reach a quorum when the application was submitted earlier in November. The Planning Commission is scheduled to meet next on December 18.
“In view of the pending new zoning ordinance, it would be well to have this submitted to the Planning Commission,” recommended Chairman Bird.
During discussion of the Fryes’ application, Dwight Frye pointed out that the notice of public hearing submitted to the Rappahannock News by the Zoning Administrator used the term “automotive garage” in describing his application. “I’m really not applying for a permit to build a garage,” Mr. Frye said. “There will be no garage, no building, no nothing.”
The Board explained that an automotive garage is permitted in an agricultural zone only if certain conditions are met under the Rappahannock Zoning Ordinance. The Fryes’ application for a special use permit
