On November 25 attorney David Konick, representing Ivan N. and Hazel C. Hall, filed a brief in Rappahannock Circuit Court arguing against the demurrers filed'by the county.
Mr. and Mrs. Hall are suing the county over a Board of Zoning Appeals decision which permits construction on subdivided lots. The proposed buildings, an Assembly of God Church and parsonage, would be built on land next to the Halls’ property.
The Halls have contended that the adjacent land was unlawfully subdivided and is in violation of the Subdivision Ordinance. They have further argued that the Board of Zoning Appeals acted unlawfully by approving a building permit for the new church and parsonage.
The Hall brief also cites an injunction issued against the county on May 24. The injunction prohibits the Rappahannock County Board of Supervisors from issuing building permits or authorizing improvements to the subdivided lot at the present time.
The county responded to the Hall suit by filing demurrers. A demurrer is a pleading which denies that allegations of a suit, even if true, could constitute a legal cause of action.
