The BZA recommended that those opposed to the possible change write a letter or talk to the Board of Supervisors regarding the new districting of the property as commercial.

In further discussion, the BZA agreed to consider a special use permit with a time limit, to ensure that recommendations are being met.

On another matter, William and Elizabeth Faulconer’s request for a variance from a subdivision requirement for their house and surrounding acreage in Chester Gap was dispensed by the BZA, due to lack of jurisdiction.

The BZA returned the Faulconers’ $40 application fee and recommended they submit their application to the Board of Supervisors.

“We’re not the Board of Subdivision Appeals — we’re the Board of Zoning,” said BZA member Greg Monahan. “This is the second time it’s happened in six months,” he said.

The BZA also went into executive session with Peter Luke, Commonwealth Attorney, to discuss “a matter of possible litigation,’ according to Chairman Bird. “W< made no resolution, but we havt given necessary instructions in th( matter to the Zoning Administratoi and the Commonwealth Attorney,’ he said.
