State law requires localities to provide for the expeditious approval of family transfers, but leaves the particulars up to the local governments. The responses differ, ranging from simple waiver of the processing and recordation fees to significant regulatory exemptions. Rappahannock falls into the second category.
The county’s present land use regulations set density on agriculturally-zoned land at one dwelling unit per 25 acres. That density may be exceeded only with a special exception permit issued by the Board of Supervisors or in a subdivision allowed through the family exception. In the second case, a lot of record as of 1962 may be subdivided into a maximum of five lots for transfer to eligible family members, with a minimum size of two acres each. The only provisos are:
