One panelist in Boston pointed out that cigarette advertising has been banned in Italy for 35 years, yet consumption there is up by more than 30 percent; he contrasted Italy to the United States, where there has been heavy advertising (though not on television) and yet the size of the market has been shrinking for 15 years.
Federal Judge Stephen Breyer, who was also on the panel, sagely reminded everyone in the hall: “There’s a little bit of censor in each of us.” What might disturb him in the proposed legislation, he said, was that “it’s a law that blocks a message” — blocks words “being used to persuade, the very function of speech.” He thought the issue boiled down to whether Congress could pass a law that prohibited a group of people from sending a certain kind of message.
It has been said that a puritan is someone obsessed by the fear that somebody out there somewhere is having a good time.' Many such puritans have been drafting into government, and Mr. Shiffrin was no doubt speaking for them when he stated: “We have to accept some limited paternalism.”
This is perhaps not quite George Orwell’s Big Brother, but it sure looks a lot like Big Nanny to me.
