APPLICATION BY OLD DOMINION ELECTRIC

COOPERATIVE AND VIRGINIA ELECTRIC AND

POWER COMPANY TO CONSTRUCT TWO NEW

GENERATING FACILITIES - CASE NO. PUE890051

On June 12, 1989, Old Dominion Electric Cooperative (“ODEC”) filed an application with the Slate Corporation Commission along with supporting prepared testimony and exhibits requesting the Commission to approve its proposal to construct a new electric generating facility under Va. Code Sec. 56-234.3 and to grant a certificate of public convenience and necessity for the facility under Va. Code Sec. 56-265.2. ODEC proposed to construct a 393 MW net, pulverized coal-fired generating facility at a site near Clover, Virginia. The contract price for construction of the unit is estimated to be approximately $447 million.

On August 15, 1989, ODEC and the Virginia Electric and Power Company (“Virginia Power”) filed a joint motion with the Commission requesting that Virginia Power be added as a co-applicant. In addition the motion asked leave to amend the application to allow ODEC and Virginia Power to construct two 393 MW pulverized coal-fired generating units at the Clover, Virginia site as a joint venture. According to the amended application, the first unit would be placed into commercial operation by December 1993, with Unit No. 2 in commercial operation by December 1994. The total cost for both units is estimated to be $804,631,814. The contract price for Unit No. 1 is $446,923,454, and $350,065,560 for Unit No. 2. Virginia Power and ODEC would own 50% of each unit.

A public hearing on ODEC’s application is scheduled for October 30, 1989, at 10:00 a.m. in the Commission’s 13lh Floor Courtroom, Jeflerson Building, Bank and Governor Streets, Richmond, Virginia to receive evidence relevant to the amended application.

A copy of the application, as amended, is available for public inspection during regular business hours at ODEC’s office located at 4201 Dominion Boulevard, Glen Allen, Virginia 23060 and all Virginia Power offices where customer bills may be paid. In addition the public may review the application from 8:15 a.m. to 5:00 p.m., Monday through Friday, at the State Corporation Commission, Document Control Center, Floor B-1, Jefferson Building, 1220 Bank Street, Richmond, Virginia.

Any person desiring to comment in writing on the application may do so by‘directing such comments on or before October 10, 1989, to the Clerk of the Commission as provided below. Any person ijesiring to make a statement at the public hearing either for or against the application need only appear in the Commission’s 13th Floor Courtroom at 9:45 a.m., on the day oi the hearing and identify himself or herself to the Bailiff as a public witness.

On or before September 29, 1989, any person desiring to participate as a protestant, as defined in Rula4:6 of the Commission’s Rules ol Practice and Procedure (“Rules”), shall file with the Clerk of the Commission tin original and twenty (2(1) copies of a notice of protest, as provided by Rule 5:16 (a) and serve a copy on ODEC’S counsel: Nathan H. Miller, Esquire, Michael L. Hem, Esquire, Kenworth E. Lion, Jr., Esquire, and William S. Bilenky, Esquire, Littert,Sipe& Miller, 4201 Dominion Boulevard, Suite 200, Glen Allen, Virginia 23060; and to Virginia Power’s counsel: John E. Cunningham, Esquire, and Darla B. Tarletz, Esquire, Virginia Electric and Power Company, P.O. Box 26666, Richmond, Virginia 23261.

Any person who expects to submit evidence, cross-examine witnesses or otherwise participate in the proceeding as a protestant pursuant to Rule 4:6, shall file on or before October 10, 1989, an original and twenty (20) copies of a protest with the Clerk of the State Corporation Commission, c/o Document Control Center, P.O. Box 2118, Richmond, Virginia 23216, referring to Case No. PUE890051, and shall simultaneously send a copy thereof to ODEC’s counsel: Nathan H. Miller, Esquire, Michael L. Hem, Esquire, Kenworth E. Lion, Jr., Esquire, and William S. Bilenky, Esquire, Litten, Sipe & Miller, 4201 Dominion Boulevard, Suite 200, Glcn*AlIen, Virginia 23060; and to Virginia Power’s counsel: John E. Cunningham, Esquire, and Darla B. Tarletz, Esquire, Virginia Electric and Power Company, P.O. Box 26666, Richmond, V irginia 23261. The protest shall set forth (i) a precise statement of the interest of the protestant in the proceeding; (ii) a full and clear statement of the facts which the protestant is prepared to prove by competent evidence; and (iii) a statement of the specific relief sought and the legal basis therefor. Any corporate entity that wishes to submit evidence, cross-examine witnesses or otherwise participate as a protestant must be represented by legal counsel in accordance with the requirements of Rule 4:8 of the Commission’s Rules of Practice and Procedure.

On or before October 10,1989,each Protestant shall file with the Clerk of the Commission an original and twenty (20) copies of the prepared testimony and exhibits the protestant intends to present at the October 30, 1989 hearing and shall simultaneously send a copy to counsel for ODEC and VEPCO and other protestants.

Any party participating as a protestant should review the instructions regarding discovery set forth in the Commission’s order in this proceeding dated August 23, 1989.
