Review of the PCB incident by the State Water Control Board also revealed that the EPA knew of PCB mishandlings as early as Sept. 30, 1986, yet did not notify the state.
Gov. Gerald L. Baliles, in a letter dated Aug. 28, told William K. Reilly, administrator at the EPA, that he was “appalled” that the EPA had prior knowledge of PCB violations. Gov. Baliles requested that Reilly institute federal clean-up and enforcement actions at Avtex under the U.S. Toxic Substances Control Act.
Three PCB inspections were conducted by the EPA under provisions of the TSCA. The first inspection, conducted on Sept. 30, 1986, reported several transformers leaking PCB oil onto the floor and a number of administrative violations, according to state officials.
Further evidence shows that the EPA proposed to fine Avtex $245,000 for PCB violations, but the action was never pursued. An EPA summary reported that EPA’s regional council was reviewing the Avtex files, but, said one state official, there is no indication of a council review.
