In a work session on the proposed zoning ordinance early this month Town Council settled some issues, at least temporarily, and left others for another time.
They decided commercial beekeeping would be defined as having more than three hives and commercial fowl or poultry would be in a chicken house larger than 200 square feet. Non-commercial beekeeping and fowl are allowed in all zoning districts, and commercial fowl and beekeeping would be allowed with a special use permit only in rural residential zones.
Attorney Frank Reynolds said as long as the ordinance continues to allow activities in rural residential zones that are not allowed in other zones, the 1.5 to 1.8 acre requirement for the zone could not be considered "exclusionary.” As now proposed, the ordinance allows “agricultural and forrestry uses and structures, including the keeping of farm animals, except swine,” by right, and other uses by special use permit.
