Judge Shore Robertson ruled in favor of Rappahannock County Thursday in a case brought by Southern American Septic of Marshall to prevent the county from contracting with Chantilly Express, an Amissville firm, for leachate collection and transportation.
The Marshall firm had sought an injunction to prevent the contract from going into effect, claiming that the county did not follow its own guidelines in awarding the contract to Chantilly, which was not licensed to haul leachate.
The request for bids stated that the contract would go to a licensed hauler.
The county maintained that did not mean the hauler had to be licensed at the time the contract was awarded—only that he had to be licensed before work under the contract began.
Cantilly Express bid 1.63 cents per gallon to haul the leachate collected at the county landfill. The firm is now licensed to haul leachate. Southern American Septic bid two cents per gallon. The county’s old contract was with Southern American Septic at 2.5 cents per gallon.
Before awarding the bid at the March meeting the supervisors considered in executive session a protest by Southern American Septic on the same issue. Following the executive session the supervisors voted to deny the protest and award the contract to Chantilly Express.
Judge Robertson said he was satisfied the county had acted correctly in awarding the contract.
