That transfer of missiles to Iran was illegal, and no sane, fair-minded person can believe otherwise. Since shortly after the Ayatollah Khomeini’s forces seized the U.S. embassy in Tehran (1979), Iran has been branded a “terrorist” state and all exports of U.S. munititions items have been banned. In addition, such a transaction would require either a State Department license (if sold through private, commercial channels) or an FMS contract (“Foreign Military Sales”: an official sale by the U.S. Government through government channels). The law does not leave any other possible legitimate channel for such an export to Iran. Furthermore, such a transaction would require formal, written notification to Congress prior to export.
