• The tax may not exceed 4 percent of the cost of purchase and is added to the purchase price by the seller. If the referendum passes, and the board of supervisors thereafter decides to enact the tax, the rate will be set after public hearing, but may not exceed 4 percent.
• The tax does not apply to vending machines, public schools or nursing homes.
• The tax does not apply to churches, fraternal, school and social organizations, fire departments and rescue squads for dinners and fund raisers where food is prepared in the homes of members or in the organization’s kitchen.
