Except the buyers bought fewer credits than they in fact could use, and we made up the difference by gift, thus protecting the buyers from possible Federal tax liability.
We intend to file a 2004 gift return with the IRS so as to make perfectly clear what we are doing.
As I see it, we have done several things in this process. Virginia has achieved incrementally better environmental protection from Rappahannock County to the Chesapeake Bay.
We have drawn cash out of the current real estate frenzy without selling any land. We have helped other family members pay their Virginia income taxes. Nothing beats win/win/win.
