With shackles around his ankles and his head hung low, Ellis Howard Smith, 56, of Castleton, told a Rappahannock County Circuit Court judge Friday he was sorry for taking indecent liberties with a 10year-old girl and didn’t mean to hurt anyone.
Smith, who was speaking at his sentencing, faced a possible 60 years in prison and a fine of $15,00Q.
Judge Jeffrey Parker then sentenced Smith to 12 years in prison. With the exception of one year and 10 months, the sentence was suspended. Parker also set the fine at $500 to be paid to the parents of the victim.
Smith will be given credit for the four months he has spent in confinement while awaiting his sentence.
“Your honor, I am a humble, but simple man, a marine and Vietnam veteran, a retired fireman with 26 and a half years experience and an EMT With 13 years experience,” wrote Smith in a letter to the judge, which was admitted as an exhibit for the defense.
“My deepest regret was getting caught up in the mistake of pretend play. . . I never meant nor intended nor ever would have, at any time, hurt neither (name of minor) nor anyone else. Words will never suffice enough to say I am sorry yet I am humbly sorry.”
