Mr. and Mrs. Stuckey from Spetryville have filed suit against the Rappahannock Board of Zoning Appeals and Paul Steven Edward DeMent for violation of county ordinances. BZA Chairman Josef Gardiner was served with a warrant immediately following the close of last Thursday’s meeting. The warrant came right on the heels of BZA action to suspend a special use permit issued several months ago to DeMent.
During Thursday’s regular meeting, BZA member George Muth warned that a suit was imminent unless the special use permit issued to DeMent was revoked. The permit allows DeMent to expand his antiques business in the Sperryville flood plain but includes conditions that limit construction to a connected addition to the existing building and that the addition be located 50 feet from both the road and the adjoining property, noted Muth.
He added that DeMent had failed to comply with either regulation.
According to Muth, DeMent was notified of the conditions in writing “but he still put the roof on, put furniture in it and I noticed yesterday that siding had been dropped off’ at the location.
“The neighbors have hired a lawyer and they’re going to file suit against the BZA if we don’t do anything,’’
