If ERA is passed, women will be able to take sex discrimination cases directly to court and the burden of proof will switch, said Clarke. Instead of women facing the almost impossible task of proving discrimination, the employer will have to show, that he is not discriminating, she explained.
Clarke reported that ratification of ERA was needed in three more states by March 22, 1979, in order for 1 the amendment to become law. Most of the states who have not acted are in the South and pro-ERA forces are running into problems there with traditional conservative views on a woman’s “proper place”—and into dirty politics, said Clarke. In Nevada, North Carolina and Florida, ERA forces campaigned for candidates who pledged to support ERA and then switched votes and opposed the amendment after election.
