Court, asking that the variance issued DeMent be thrown out since it was in violation of county ordinances. Hearing on the suit is scheduled for July 11. If the ruling goes against DeMent, he can either appeal to the Circuit Court or tear down the structure.
Earlier in the meeting, the BZA considered another special use permit application for remodeling in the Sperryville flood plain. Bob Haase, representing Country Cupboards in Washington, requested a variance for remodeling and upgrading the old Co-op building into a cabinet shop.
"Our intention is to restore that building in a desirable manner,” said Haase. He told the Board that plans call for part of the structure to be used as a cabinet shop and part to be rented to a compatible enterprise.
“There’s no question in my mind that this will improve the neighborhood,” said McNear. “It’s a nice business for Rappahannock to have but it is in a flood plain,” he reminded the Board. He advised the BZA members to approve the special use permit application if they had no concern over someone upsetting the decision through a court appeal.
