“Isn’t a zoning ordinance that seeks to limit growth going to run afoul of the courts?” asked Lee Bird.
Mrs. Malta replied that Virginia localities can control growth only through a comprehensive plan by setting density requirements based on services. Rights to develop can’t be taken away, she added, only discouraged.
“Don’t make the mistake of spreading low density over your whole county,” she advised the RLEP audience. Heads bobbed in agreement She added that it’s preferrable to have town houses or apartments in one small space where services are cheaper and leave the rest of the land open.
“There’s one bright spot,” Mrs. Malta commented. “More and more people are becoming aware (of the problems uncontrolled growth creates). Laws can be changed if people put on enough pressure,” she concluded.
