and allows land to be taxed differently “only in regard to non-revenue producing government services.” He explained that land with lower intensity uses will require less government services and so can legally be taxed at a lower rate. However, he noted, forestry land within an AF District will require the same level of government services as forestry land outside the district. Since forestry land is not allowed preferential tax treatment under Orange’s Land Use tax law, Purcell argued that forestry land must also be excluded from use value taxation within an AF District.

If the Attorney General says otherwise, it’s “just one man’s opinion,’’ said Purcell. “I don’t mean to belittle it but 1 believe that it’s wrong. Period.”
