Game warden Jim Bankston countered that the wording of the ordinances adopted in Fauquier was “substantially changed” from those proposed for Rappahannock. In addition, he noted that Fauquier’s laws had been enacted under an entirely different code reference. “If they had worded theirs as we worded ours—and as Culpeper worded theirs — they (Fauquier County) wouldn't have had a problem,” Bankston contended.

He added that current law may consider possession of a loaded gun as presumption of hunting but unless a shot is actually fired, there’s “no violation.”
