On Monday. Judge Snead also noted that the Board of Zoning Appeals did not have the power to act on his ruling; that enforcement of county zoning ordinances was the responsibility of the Board of Supervisors and the Commonwealth Attorney.
In effect, Snead’s rulings leave the addition to DeMent’s antique business without authorization under county law. As a result, Commonwealth Attorney could order that the building be torn down since it doesn’t comply with zoning ordinance regulations. When asked to comment on the case. Davis said the matter was “under further study.”
Waugh Crigler, attorney for DeMent in the case, said on Tuesday that his client had made no decision on what, if any, action to take in light of Snead's ruling. Noting that the Judge's final order had not yet been formally entered, Crigler said that DeMent was going to wait and see "what takes place...The facts and circumstances during the 30 days (following the filing of the formal order) will determine our response.”
