The legal advertisement as printed in the Rappahannock News reported that Cook was asking for a permit to build a second dwelling on his oneacre lot on Route 647 six miles from Flint Hill. But according to Cook’s testimony at the BZA meeting he has 1.9 acres while records in the commissioner of revenue’s office show he has 1.6 acres.
Supervisor chairman E. P. Luke, who attended part of the BZA session, said later that Cook’s parcel is a subdivided lot under the allowance in section 2-31C in the subdivision ordinance for five land divisions for transfer to parent or child. He noted, however, that whether the parcel is one, 1.6 or 1.9 acres, it’s still smaller than the two acres stipulated as the minimum lot size under the section 2-31C exception.
