In his will dated February 20, 1948, Robert Eugene Wood divided the bulk of his estate between the "cancer and heart funds of Virginia.” His heirs-at-law, three nephews and a niece, have likewise challenged the bequest on the grounds that it is indefinite and vague and that the failure of the will to specify whether the estate is to be divided equally makes it impossible to administer.
In setting up the procedures to be followed in Monday's hearing, Circuit Court Judge Shore Robertson announced he would allow wide latitude on evidence. He noted that attorneys for all the parties involved could state objections which would be noted in the record and rules on at a later date prior to the court’s decision on the case.
