(Continued from Page 8) Addressing the requirement for rezoning as a first step in subdivision development, Miller noted that any divisions over five lots or, any divisions of land contiguous to an existing subdivision must go through the rezoning process.
"You’re treating two people with the same land in the same district differently,” McNear said. It’s not equal treatment when the first landowner on a road can divide his property into five lots with only administrative approval while his neighbor who tries to subdivide after him has to get a rezoning of his property simply because he came second, the planner said.
“If that’s exclusionary, maybe we need to have all property rezoned before it can be subdivided,” Miller responded.
