Problems With Atkins Lot
“There are some problems I see with the last lot you created,” said Miller in reference to the action on Mrs. Atkins' request. "Will it perc?” he asked, referring to the lot’s suitability for sewage disposal in a septic drainfield. “How long will the man live?” Miller questioned, noting that in an earlier case of medical hardship, the individual died before the action approved in the variance could be carried through.
He pointed out that in granting a hardship variance, the BZA must comply with specific criteria set out in section 16-2-2 of the zoning ordinance.
