Criminal Trial Changes
Sen. Herbert H. Bateman (R-Newport News) introduced two bills in the Senate that would alter the way judges and juries handle criminal trials.
The first bill would give judges the authority to sentence defendants in most criminal cases, a duty now handled largely by juries. In such cases, juries still would determine a defendant's guilt or innocence.
But Sen. Bateman said judges, after receiving a jury's verdict, would be able to consider additional evidence, including the defendant's prior criminal record, in imposing sentences "on a more intelligent and rationals basis.”
In those instances, judges would be able to determine the sentence except in cases of capital murder in which the death penalty could be imposed.
