While the 1%2 Attorney General's opinion apparently would preempt any action from Rappahannock to prohibit hunting deer with dogs. Baumgardner points out that section 29-213.17 of the Virginia Code confers on the supervisors authority to control dogs from running at large “during such months of the year as they may designate."
The code section further defines running at large as the roaming, running or selfhunting off the property of the owners and “not under the owner’s immediate control."
The portion referring to the owner’s immediate control could be interpreted as applying to deer hunters loosing dogs to Hush deer off property which they do not own. according to the commonwealth’s attorney.
