Rappahannock %«•»»•* Staff W ritcr The Commonwealth’s attorney met with Rappahannock’s Board of Zoning Appeals in an executive session Tuesday morning to discuss legal questions involved in a variance request from Wayne Jenkins.

Jenkins, contract owner of a lot on Route 626 near Washington, is seeking a variance on side setback regulations which require a minimum of 50 feet side yard for single family residences on agriculturally zoned land. The lot he is seeking to buy from Warrenton speculator David Farrar is just 95 feet wide at its widest point.

At a public hearing on the variance request held February 5, BZA chairman Lee Bird pointed out that side setback regulations in the zoning ordinance appear to conflict with a second provision that stipulates one single family residence may be erected on any lot recorded prior to the 1973 zoning ordinance adoption, provided health department criteria on septic fields and
