ERA
Six senators filed a petition last week with the Virginia Supreme Court, asking the court to declare that the Virginia Senate has ratified the Equal Rights Amendment (ERA).
The ERA received a 20-19 majority in the Senate two weeks ago but failed because Senate rules require 21 votes for ratification of an amendment to the U. S. Constitution.
Former Del. Elise B. Heinz filed the petition on behalf of the senators after notifying Lt. Gov. Richard J. Davis and Senate Clerk J. T. Shropshire, who were both named as defendants. The petition states that the 21-vote rule violates the state constitution. Sen. Joseph V. Gartlan Jr. (D-Fairfax). one of the senators who filed the petition, protested Davis’ ruling that the ERA failed even though it got a 20-19 majority. But Gartlan's appeal was rejected by the Senate.
