He said he'd called [he commonwealth attorney at 11:30 p.m. and asked Douglas Baumgardner to come to his house to listen but had been told that Baumgardner couldn't. At 1 a.m.. Smoot said, he called the jailor, only to be told that no law enforcement personnel were available.
