“The Board of Zoning Appeals has jurisdiction in this matter,” responded commonwealth’s attorney Douglas Baumgardner, adding that the supervisors had given the BZA power to consider special use permits. If citizens object to granting of a permit, the proper remedy is to file a suit, asking for review by the circuit court, he said.
Baumgardner noted, however, that the supervisors can consider Mrs. Donald’s comments in connection with the ongoing revision of the county's zoning ordinances and suggested she send copies of her remarks to the planning commission.
