NOTICE OF SPECIAL COMMISSIONER’S
SALE OF VALUABLE REAL ESTATE
SATURDAY, JUNE 29,1985,
AT 11:00 A.M.
Pursuant to a Decretal Order of the Circuit Court of Rappahannock County, Virginia, entered on the 6th day of June 1985, in the partition suit brought by Elaine Metz and others against James Hamilton Comma, and others, Chancery No. 3238, the undersigned Special Commissioner will, on Saturday, the 29th day of June, 1985, at the front door of the Courthouse of Rappahannock County, Virginia at 11:00 A.M., offer for sale to the highest bidder, the following described real estate known as the ‘Mossie Brown Property”, located in the Jackson Magisterial District, Rappahannock County, Virginia, to-wit:
That certain tract of real estate consisting of 12.01
acres, more or less, with all improvements thereon, situated
in the Jackson Magisterial District of Rappahannock
County, Virginia, and being the same lands
described according to plat and survey of Rush W.
Boyer, Surveyor, dated August, 1973 and recorded
amongst the land records of the Clerk s Office of the
Circuit Court of Rappahannock County, Virginia, in
Deed Book 134 at Page 707. Said land is a portion of
the same land acquired by Mossie H. Brown and Estelle
Russell Brown, husband and wife, as tenants by
the entireties with the right of survivorship as at common
law, by deed of Mossie H. Brown, et ux dated April
19,1966 and recorded April 20,1966 amongst the land
records of the above described Clerk’s Office in Deed
Book 86 at Page 53.
Reference is hereby made to the aforesaid land records and, in particular, Chancery File 3238, for a more complete and accurate description of the property.
TERMS OF SALE: ALL CASH. A deposit of ten percent (10%) of the sales price will be required at the time of sale. THE SALE IS SUBJECT TO THE APPROVAL OF AND CONFIRMATION BY THE CIRCUIT COURT OF RAPPAHANNOCK COUNTY, VIRGINIA. Settlement and compliance with the terms of sale to be had and complied with within thirty (30) days of the date of sale. In the event of default by the purchaser, the Court reserves the right to declare a forfeiture of the deposit, keep the deposit, and readvertise and resell the property at the risk and cost of the defaulting purchaser.
The Special Commissioner makes no representations as to the physical characteristics or condition of any improvements located on the property. Prospective bidders are encouraged to inspect the property prior to the date of sale. The property is to be sold subject to all covenants, restrictions anj easements of record. All cash proceeds from this sale will be deposited with the Farmers and Merchants National Bank of Winchester, Virginia, General Receiver of the Circuit Court of Rappahannock County, Virginia.
